Terms of Use and Privacy Policy
Terms of Use
Last Updated: September 17, 2026
These Terms & Conditions (the “Terms”) govern access to and use of the website, online forms, booking features, digital content, and other online services operated by Second Peak Training Corporation (“we,” “us,” or “our”). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
Website Use
You may use the Website only for lawful purposes and in accordance with these Terms. You may not use the Website in a manner that could damage, disable, overburden, impair, or interfere with its operation or with another person’s use of the Website.
Fitness Services and Separate Client Agreements
These Terms govern use of the Website. They do not replace any client service agreement, informed-consent form, health questionnaire, liability waiver, package agreement, or other document that may apply to training or coaching services.
If you purchase, book, or participate in services, additional terms may be provided before or at the time services begin. Those service-specific terms govern matters such as scope of services, scheduling, payment obligations, cancellation rights, and participation requirements. If these Terms conflict with a signed or accepted service-specific agreement, the service-specific agreement controls with respect to the services covered by that agreement.
Health and Medical Disclaimer
The Website and any general educational materials provided through it are for informational and fitness-education purposes only. They are not medical advice and are not intended to diagnose, treat, cure, prevent, or manage any disease, injury, disability, or medical condition.
Before beginning or materially changing an exercise program, you should consider consulting a qualified healthcare professional when appropriate for your individual circumstances. Do not disregard professional medical advice or delay seeking medical care because of information obtained through the Website. If you believe you are experiencing a medical emergency, contact 911 or another appropriate emergency service.
Client Responsibility and Safety
Clients are responsible for providing accurate and complete information reasonably relevant to safe participation, including information requested in health, readiness, or intake forms. Clients should promptly communicate pain, dizziness, unusual shortness of breath, loss of balance, new injury, material changes in health status, or other symptoms that may affect participation.
You remain responsible for deciding whether to perform any exercise or movement and should stop an activity if it causes unexpected pain, significant discomfort, or symptoms that concern you.
Risks of Exercise and No Guarantee of Results
Physical activity involves inherent risks, including strains, sprains, falls, muscle soreness, aggravation of existing conditions, cardiovascular events, and other injuries or adverse outcomes. The nature and degree of risk vary by individual, activity, environment, and health status.
Second Peak Training Corporation does not guarantee any particular physical, health, mobility, strength, weight, pain, rehabilitation, or other outcome. Results vary and depend on many factors, including participation, consistency, health status, nutrition, recovery, prior training, and individual response to exercise.
Scheduling, Pricing, Payments, Cancellations, and Refunds
Prices, package details, payment timing, scheduling rules, cancellation rights, refund terms, expiration dates, and any recurring-payment terms applicable to services will be disclosed through the applicable booking process, checkout page, service agreement, or other written terms provided to the client.
All purchases and cancellations remain subject to any mandatory rights and requirements under applicable law. Nothing in these Terms limits a consumer right that cannot lawfully be waived or restricted.
Online Booking and Third-Party Services
The Website may use third-party platforms for scheduling, payment processing, forms, video conferencing, email delivery, analytics, or other functions. Your use of a third-party service may also be subject to that provider’s own terms and privacy practices.
We do not control the availability, security, performance, or independent policies of third-party services. To the extent permitted by law, Second Peak Training Corporation is not responsible for losses caused solely by a third-party platform outside our reasonable control.
Electronic Communications
When you submit a form, request information, schedule an appointment, make a purchase, or otherwise contact Second Peak Training Corporation electronically, you consent to receive communications reasonably related to your inquiry, appointment, transaction, or client relationship. Marketing or promotional communications will be sent only as permitted by applicable law and any separate consent you provide.
Acceptable Use
You agree not to use the Website to violate any law; infringe the rights of others; transmit malicious code; interfere with Website security or operation; scrape, copy, or harvest content or personal information through unauthorized automated means; attempt to gain unauthorized access to systems or accounts; misrepresent your identity or affiliation; or use Website content for unlawful, misleading, or fraudulent purposes.
We may suspend or restrict access to the Website if we reasonably believe its use violates these Terms, threatens security, infringes rights, or disrupts Website operation.
Intellectual Property
Unless otherwise stated, the Website and its original content, including text, training materials, graphics, logos, photographs, videos, illustrations, downloadable materials, and the arrangement and presentation of those materials, are owned by or licensed to Second Peak Training Corporation and are protected by applicable intellectual-property laws.
You may view and use Website content for personal, non-commercial use. You may not reproduce, distribute, modify, publish, sell, license, create derivative works from, or commercially exploit Website content without prior written permission, except where permitted by law.
User Submissions and Feedback
If you voluntarily submit feedback, comments, testimonials, suggestions, or other non-confidential content to Second Peak Training Corporation, you represent that you have the right to provide it. Second Peak Training Corporation may use ordinary business feedback and suggestions to improve its services.
Second Peak Training Corporation will not publicly use your name, image, testimonial, or identifiable client story for promotional purposes without obtaining any consent required by applicable law.
Third-Party Links and Resources
The Website may contain links to websites, products, articles, services, or resources operated by third parties. Links are provided for convenience and do not necessarily constitute an endorsement. Second Peak Training Corporation is not responsible for the content, accuracy, availability, security, or privacy practices of third-party websites.
Privacy
Use of personal information in connection with the Website and services is described in the Privacy Policy included below. The Privacy Policy forms part of these Terms to the extent applicable to use of the Website.
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. SECOND PEAK TRAINING CORPORATION DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY OTHER WARRANTIES THAT MAY OTHERWISE ARISE BY LAW, COURSE OF DEALING, OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ALL INFORMATION WILL ALWAYS BE COMPLETE, CURRENT, OR SUITABLE FOR YOUR INDIVIDUAL CIRCUMSTANCES.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SECOND PEAK TRAINING CORPORATION AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO USE OF, OR INABILITY TO USE, THE WEBSITE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECOND PEAK TRAINING CORPORATION’S AGGREGATE LIABILITY FOR CLAIMS ARISING SOLELY FROM USE OF THE WEBSITE WILL NOT EXCEED THE AMOUNT, IF ANY, YOU PAID DIRECTLY TO SECOND PEAK TRAINING CORPORATION FOR THE SPECIFIC WEBSITE-BASED TRANSACTION GIVING RISE TO THE CLAIM.
THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. LIABILITY RELATING TO PAID FITNESS SERVICES MAY ALSO BE ADDRESSED IN A SEPARATE CLIENT AGREEMENT.
Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Second Peak Training Corporation and its owners, employees, contractors, and agents from third-party claims, liabilities, damages, losses, and reasonable costs arising from your unlawful misuse of the Website, your material violation of these Terms, or your infringement of another person’s rights.
Governing Law and Venue
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except to the extent another jurisdiction’s mandatory consumer-protection law applies.
Subject to any mandatory rights available under applicable law, disputes arising solely from these Terms or use of the Website will be brought in a state or federal court of competent jurisdiction located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.
Changes to the Website and These Terms
Second Peak Training Corporation may update the Website and revise these Terms from time to time. When material changes are made, the revised Terms will be posted with an updated effective date. Changes apply prospectively from the date posted unless a different date is stated or applicable law requires otherwise.
Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law.
Suspension or Termination of Website Access
Second Peak Training Corporation may suspend, discontinue, or modify all or part of the Website at any time, subject to applicable law. Second Peak Training Corporation may also restrict access to users who materially violate these Terms or misuse the Website. Provisions that by their nature should survive termination will remain in effect.
Severability and No Waiver
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. A failure by Second Peak Training Corporation to enforce a provision of these Terms is not a waiver of the right to enforce that provision or any other provision later.
Entire Agreement
These Terms and the Privacy Policy below constitute the agreement between you and Second Peak Training Corporation regarding use of the Website, together with any other Website-specific policy expressly incorporated by reference. Separate signed or accepted service agreements may govern coaching, training, memberships, packages, or other paid services.
